NDC in court for injunction to halt EC from printing Amenfi Central ballots – My XYZ online

The opposition National Democratic Congress (NDC) is seeking an injunction to restrain the Electoral Commission (EC) from proceeding with the printing of parliamentary ballot papers and notice of poll for the Amenfi Central constituency.

This was revealed by the Head of Legal Affairs of the party, Edudzi Tamekloe on TV XYZ.

The development comes after the Electoral Commission, in a letter signed by the Deputy Chairman of the EC in charge of Operations, Samuel Tettey, announced the disqualification of the  NDC Parliamentary Candidate for Amenfi Central, Madam Joana Cudjoe.

The letter, dated October 10, 2024, stated that the Commission is bound by the court order, which has neither been stayed nor vacated.

Reacting to the matter, Tamakloe said the party has already filed a writ in an Accra High Court to challenge the decision of the EC to disqualify the party’s parliamentary candidate for the Amenfi Central.

He described the decision of the EC as mischievous, stating that the Commission was a party to an interlocutory injunction against the candidate, Joana Gyan Cudjoe’s election in the May 12 primary.

He said the NDC was waiting for the court to hear the injunction case next week so they could proceed with the necessary action.

“We are seeking for injunction so we are urging all party members in the area to remain calm as we deal with the challenges,” Tamekloe stated.

    Background

The disqualification of Joana Cudjoe stems from an interlocutory injunction issued by the Sekondi High Court, which prevents the EC from recognizing Cudjoe as the NDC’s candidate for the upcoming December 7 elections.

The court’s injunction is reportedly related to a pending lawsuit concerning Cudjoe’s eligibility, which has not been resolved or lifted, thereby blocking her from contesting in the parliamentary race.
