    Supreme Court bailiff posts substituted service at residence of Tema Central MP

    A bailiff of the Supreme Court on Friday, February 21 served the Member of Parliament for Tema Central constituency, Charles Forson a substituted service following the approval of the application granted by the Supreme court.

    The notice of substituted service which was posted on the residence of Charles Forson was necessitated after several efforts to effect personal service of the certiorari application failed.

    Lawyers of the NDC parliamentary candidates led by Seth Nyaaba disclosed to the court on Thursday, February 6, 2025, that efforts to serve the court documents on the NPP candidates had proven futile and would require substituted service to serve the documents.

    “More than three unsuccessful attempts have been made to effect personal service of the certiorari application, and the supplementary affidavit in support of the certiorari application in support on the 2nd to 5th Interested Parties.

    “Any further attempt to serve the 2nd to 5th Interested Parties with another hearing notice for the hearing of the Certiorari application may be practically impossible due to the experiences gathered from the service of the hearing notice for the 23rd January 2025 hearing,” he explained.

    Per the Supreme courts direction, the service should be done by posting copies of the certiorari application, the supplementary affidavit in support of the certiorari application and the hearing notice on the notice board of the Supreme Court, the residences of the defendants, the legal department of the Office of Parliament and via WhatsApp.

    The NDC filed an earlier application to quash the high Court decision which ordered the EC to collate and declare parliamentary  results  for Techiman South, Okaikwei Central, Tema Central and Ablekuma North constituencies.

    Following the declaration of Charles Forson of the New Patriotic Party (NPP) as Member of Parliament elect for the Tema Central constituency, Ebi Bright, the parliamentary candidate for the National Democratic Congress (NDC) in the constituency filed a petition at the Supreme Court challenging the EC’s declaration.

    The petition, filed on January 22, 2025, alleges electoral irregularities and misconduct during the December 7, 2024, parliamentary elections.

    Ebi Bright claims in her petition that the Electoral Commission (EC) wrongfully declared Charles Forson as the winner despite alleged discrepancies in the election results.
